Notice on Inspection and Quarantine Requirements for imported wild aquatic products from Papua New Guinea

  According to China’s relevant laws and regulations and the General Administration of Customs of the People’s Republic of China and the independent state of Papua New Guinea fisheries and Marine resources of Papua New Guinea to China wild aquatic products inspection and quarantine and veterinary sanitary requirements protocol rules, from now on, allowed to meet the following requirements of Papua New Guinea wild aquatic products import:

  I. Basis for inspection and quarantine

  (1) Law of the People’s Republic of China on the Entry and Exit Animal and Plant Quarantine, Regulations for the Implementation of Law of the People’s Republic of China on the Entry and Exit Animal and Plant Quarantine, Law of the People’s Republic of China on the Inspection of Import and Export Commodities, Regulations for the Implementation of Law of the People’s Republic of China on the Inspection of Import and Export Commodities, Food Safety Law of the People’s Republic of China, Regulations for the Implementation of the Food Safety Law of the People’s Republic of China.

  (2) Measures of the People’s Republic of China on the Safety Administration of Import and Export Food and Provisions of the People’s Republic of China on the Registration Administration of Overseas Production Enterprises of Imported Food.

  (3) Protocol between the General Administration of Customs of the People’s Republic of China and the Ministry of Fisheries and Marine Resources of the Independent State of Papua New Guinea on Inspection, Quarantine and Veterinary Health Requirements for Wild Aquatic Products exported from Papua New Guinea to China (hereinafter referred to as the Protocol).

  II. Scope of imported products

  Wild aquatic products refer to wild aquatic animal products and their products for human consumption, Marine plant products and their products such as algae, excluding species listed in the Appendix of CITES or the List of Wildlife under Special State Protection in China, live aquatic animals and breeding materials of aquatic animals and plants.

  III. Requirements of production enterprises

  Production enterprises (including processing enterprises, fishing vessels, transport vessels, processing vessels and independent cold storage) that export wild aquatic products to China shall be subject to the approval and effective supervision of the Ministry of Fisheries and Marine Resources of the Independent State of Papua New Guinea (hereinafter referred to as “PNG”). The sanitary conditions shall comply with the requirements of the General Administration of Customs of the People’s Republic of China (hereinafter referred to as the “Chinese Side”) and the relevant veterinary health and public health regulations of Papua New Guinea.

  Enterprises exporting wild aquatic products to China in accordance with the Food Safety Law of the People’s Republic of China and the Regulations for the Implementation of the Law of the People’s Republic of China on the Entry and Exit Animal and Plant Quarantine shall be recommended by Papua New Guinea to register with the Chinese side. No export shall be allowed to China without registration. The types of products that the manufacturer applies for registration in China shall be within the “Scope of imported products”.

  IV. Requirements for imported products

  Papua New Guinea should ensure that wild aquatic products exported to China meet the following conditions:

  (1) Fishing legally in national or international waters.

  (2) Raw materials and products are not in the area of concern listed below:

  1. A notifiable aquatic animal disease stipulated by the World Organization for Animal Health (OIE) has occurred in Papua New Guinea, causing or possibly infecting wild aquatic products exported to China.

  2. A major food safety incident in Papua New Guinea has affected or may affect wild aquatic products exported to China.

  3. Any major public health event, such as infection of employees with COVID-19 or other major infectious diseases, has contaminated or may contaminate wild aquatic products exported to China, as well as their packaging and transportation means.

  4. Papua New Guinea has exported or intends to export wild aquatic products to China in serious violation of Chinese laws and regulations and provisions of this Protocol.

  (3) Not directly or indirectly using drugs or additives prohibited by the Chinese side, but using drugs or additives restricted or permitted by the Chinese side according to regulations; Upon inspection by the competent authorities, no pathogenic microorganisms, toxic and harmful substances and foreign bodies listed in Chinese laws and regulations were found.

  (4) All wild aquatic products exported to China have been found to be hygienic after quarantine inspection by the competent authorities, and no pathological indications of any infectious or parasitic diseases or aquatic animal epidemics listed in China or the World Organization for Animal Health have been found.

  (5) The whole process of fishing, processing, packaging, storage, transportation and export shall meet the relevant health requirements and traceability requirements of China and Papua New Guinea, and the normal operation of the cold chain control shall be ensured.

  (6) During the epidemic period of COVID-19, enterprises should carry out epidemic prevention and control according to the guidelines on COVID-19 and food safety issued by the Food and Agriculture Organization of the United Nations and the World Health Organization, conduct regular disease testing for employees, and establish necessary safety prevention and control measures for wild aquatic products. Ensure the effective implementation of prevention and control measures in the whole process from raw materials, processing, packaging, storage and transportation to prevent contamination.

  V. Certificate requirements

  Each container of wild aquatic products exported to China shall be accompanied by at least one original veterinary (hygiene) certificate certifing that the products comply with the veterinary and public health laws and regulations of China and Papua New Guinea and the relevant provisions of the Protocol. PNG should complete in the veterinary (health) certificate from fishing, processing, packaging, storage, transportation, transit and export enterprise information involved in the whole process, such as production, including the processing factory, boats, carrier, processing craft and independent refrigerator’s name and registration number, etc., shall not omit any of these links involved in the production of enterprise information.

  The certificate is printed in Chinese and English (English must be filled in when filling in the certificate). The format and content of the certificate must be approved by both parties in advance. The Papua New Guinea side shall timely provide the sample of health certificate, official certificators and their seals, list of official veterinary officers and their signatures and other information to the Chinese side for record. If there is any change in the content and format of the sample certificate, Papua New Guinea should file it with China at least one month before it takes effect.

  VI. Packaging and marking requirements

  The wild aquatic products exported to China shall be packed with new materials in line with international hygienic standards, and shall have separate inner and outer packaging, which shall meet the requirements of preventing pollution from external factors.

  Labels in Chinese shall be affixed to the internal and external packaging, including: product name and scientific name, specifications, production date, batch number, storage conditions, production mode (wild), country of origin, production region (state/province/city), manufacturer’s name and registration number, destination (marked as the People’s Republic of China).

  For wild aquatic products exported to China in the form of pre-packaged, the pre-packaged Chinese labels should meet the requirements for the labels of pre-packaged food imported from China.

  VII. Other requirements

  The Chinese Customs carries out import inspection and quarantine on wild aquatic products exported to China.

  Non-conforming products will be returned, destroyed or otherwise disposed of in accordance with Chinese laws and regulations. For manufacturers with serious problems or repeated unqualified problems, China may take measures such as strengthening inspection and quarantine or banning imports.
