Announcement No. 106, 2021 of the General Administration of Customs (Announcement concerning the Implementation of the Regional Comprehensive Economic Partnership Agreement)

? ? ? ? Upon the approval of The State Council, the Regional Comprehensive Economic Partnership Agreement (HEREINAFTER referred to as the Agreement) officially enters into force on January 1, 2022. In accordance with the Measures of the Customs of the People’s Republic of China on the Administration of Origin of Import and Export Goods under the Regional Comprehensive Economic Partnership Agreement (hereinafter referred to as the Measures, promulgated by Order No. 255 of the General Administration of Customs), the relevant matters are hereby announced as follows:

? ? ? ? I. The members mentioned in the Measures and this Announcement refer to China, Brunei, Cambodia, Laos, Singapore, Thailand, Vietnam, Japan, New Zealand, Australia and other countries that have formally implemented the AGREEMENT as of January 1, 2022. The General Administration of Customs will make a separate announcement if there is any subsequent change in the scope of members.

? ? ? ? II. Where the consignees of import goods or their agents (hereinafter referred to as importers) or consignors of export goods or their agents go through customs declaration procedures for goods under the A A GRE ement, Fill in the Customs Declaration form of the People’s Republic of China for Import (Export) Goods (hereinafter referred to as the Declaration Form) and submit the certificate of origin in accordance with the relevant requirements of “Goods imported under preferential Trade Agreements for which electronic information exchange of origin has not been realized” in announcement No. 34, 2021 of the General Administration of Customs. The preferential trade agreement code of the Agreement is “22”.

? ? ? ? ? ? ? ? (II) In the case of applying for the application of the highest tariff rate under the AGREEMENT applicable to goods of the same origin of all other members, “Origin unknown (according to the highest tariff rate of all members)” shall be filled in the column of “Origin under preferential Trade Agreement” in the Customs Declaration form.

? ? ? ? IV. According to Article 33 of the Measures, the applicant may apply to the Customs, the China Council for the Promotion of International Trade and its local branches and other Chinese visa agencies for issuing the Certificate of origin under the A gre ement.

? ? ? ? Certificates of origin exported to Singapore, Thailand, Japan, New Zealand and Australia under the AGREEMENT are self-printable certificates. Relevant matters shall be governed by announcement No. 77, 2019 of the General Administration of Customs.

? ? ? ? V. Approved exporters recognized by the Customs shall issue a declaration of origin in accordance with order No. 254 of the General Administration of Customs and relevant announcements.

? ? ? ? VI. Applicants or approved exporters who apply for the issuance or issuance of back-to-back certificates of origin in accordance with Article 22 of the Measures and fail to fill in the electronic data of initial certificates of origin through the System for The Declaration of Elements of Origin under preferential Trade Agreements when goods enter the country shall fill in a supplementary form.

For goods in transit that have been exported from other member countries before the ENTRY into force of THE A GRE ement but have not yet arrived in China, the importer may apply for the agreed tariff rate under the A GRE ement if he submits the valid certificate of origin to the Customs before 30 June 2022.

For goods in transit that have been exported from China before the ENTRY into force of the AGREEMENT but have not yet arrived at other member countries, the applicant may apply for a new certificate of origin before June 30, 2022 in accordance with the Measures, and the approved exporter may issue a declaration of origin.

? ? ? ? VIII. See Annex 1 for the rules of origin for products specified in Article 3 of the Measures; The Special List of Goods referred to in Article 14 is annex 2; Please refer to Annex 3 for the format and filling instructions of the CO (CEPA) mentioned in Article 18. Please refer to Annex 4 for the minimum information requirements for the CO (CEPA). The supplementary declaration to the customs mentioned in Article 29 is in Annex five.
